Standard Digital News - Kenya : Law Society of Kenya tightening ...

By ROBERT NYASATO

Law Society of Kenya ( LSK) has drafted a Bill aimed at streamlining the profession.

Dubbed The Standard Bill, once passed into law, LSK will be able to deal with rogue advocates, as members? offices will regularly be inspected to establish if they comply with provisions.

East Africa Law Society President and LSK council member James Mwamu said the Bill has been finalised and was due for tabling in Parliament for deliberations.

He said advocates who failed to renew their practising certificates will be required to face disciplinary action before being allowed to practice so that they state why they flouted rules.

New perspectives

Mwamu was addressing the Press after opening Continuing Legal Education seminar on criminal law and practice titled new perspectives in Kisii.

He said the society was concerned with reports that clients had lost cases in court merely because an advocate representing them had failed to renew licence. ?Such behaviours are eroding the public?s confidence in the legal profession,? Mwamu quipped.

He said it had come to their realisation that most members of the public do not access internet services where they can easily confirm, who is a duly licensed advocate. The official said soon, they would circulate names of advocates in the current roll to all courts for the public to be in the know.

?People don?t pay money for legal services out of luxury but they want justice. We are working closely with the chief registrar to curb this menace,? he assured.

Mwamu acknowledged that the vice was a worldwide problem, saying some advocates struck of the roll change locations and continue to practice.

?Once the law is passed, we will follow up on advocates struck off to find out what they are doing for a living,? he added, noting that by the end of the year, the law will be in force.
